“privacy is protean”: frogger & the future of privacy

In this lecture, Ian Kerr investigates changing conceptions of privacy
through a consideration of four sets of technologies: two that have been
dealt with by both the United States and Canadian supreme courts
(forward looking infrared & snoop dogs), one that is working its way
through the lower courts in the United States (functional magnetic
resonance imaging), and one that has not been dealt with by either of the
courts (ultra- and hypersonic sound). Although distinct in their application
of science and engineering, all four sets of technologies exploit
“information emanation”. These examples are used to articulate the
changing nature of privacy, with the aim of generating potential solutions
that will “leapfrog” what Kerr will describe as the courts’ current “frogger”
approach.
